Differences in guidance from various organisations is preventing uniform standards of practiceThe emphasis in medical law and ethics on protecting the patient’s right to choose is at an all time high. Apart from circumscribed situations, for instance where the Mental Health Act 19831 is applicable, the only justification for medically treating an adult patient against his or her wishes is on the basis of common law, using the principle of best interests, and only when he or she lacks capacity to (...) refuse treatment. As a result, it is important that clinicians should be able to assess capacity to refuse treatment. Given that judgements of incapacity involve deciding that a person does not have the ability to refuse treatment, a great deal of care needs to go into the assessment and characterisation of incapacity.There is divergence between the characterisation of capacity that is used by the courts and that which is recommended by the British Medical Association . The BMA usefully expands on the first element of capacity as set out in the standard legal definition of capacity in the Re C judgment2 but ignores the other two elements. By doing this, the BMA makes it unclear whether it is rejecting these as relevant to capacity; it also misses the opportunity to expand on these elements in a clinically useful way.We will begin with a description of the BMA’s advice3 and the standard English legal definition of capacity.2,4 Then we will show that there are important discrepancies between these two sources of advice. His is ultimately an entitlement or rights ethic, rather than an aitial ethic of goal-purposive fulfillment for the individual, projected outwards for a common good scenario. While his rejection of goal ethics's inability to detail principles for distribution of goods is noteworthy, it does not appear that a tightened version of generic rights theory will come closer to either of Phillips's desiderata: a justification of moral reasoning apart from any theory of nature or a calculus for its application. Desan and Phillips wish to think against the limits of the human situation. For Desan, rising above limitation is a moral task and obligation facing us each, if there is to be a common future. His call is to be World Citizen in a Polis of Nations. Phillips's vision is more concrete, a distribution of benefits to benefit all with well-being and freedom. But this mundane task is no less difficult than Desan's transcendent one. Indeed, according to Augustine, even the Divine Mind must utilize an artifice in dealing with human creation: "He loves each of us as though there were only one of us." Even to list the changes and events which occurred in seventeenth century England is a difficult task: the century spans the period from the death of Queen Elizabeth to the Glorious Revolution and beyond, through the Civil War, the accession and exile (twice) of the Stuarts, the rise of science, the transformation of the theological and religious issues of the English Reformation, to name only the most obvious. To conceive a book, in the form of occasional essays, which not only addresses these changes and events but does so by establishing the connections which were present with European currents at the same time surely tempts fate, even when it does not tempt reviewers. BOOK REVIEWS 571 But Hugh Trevor-Roper is a master, both of the period under survey and of the form of the essay. With one exception, each of these essays began as a lecture or seminar paper, and the pleasantly legible style in which they are written must bear some trace of that origin. The occasional flashes of wit, mixed with rthe fairly non-technical style, make the book a joy to read and a welcome escape from the usually constipated style of scholarly prose. In his Introduction, the essayist clearly sets forth his thesis that English intellectual history does not exist apart from the currents of European intellectual history (a thesis for which Trevor-Roper has already staked a claim). That leads to what may very well be the major problem with these essays: its end is in its beginning. The list of names cited in these essays only partially coincides with the list of names in the index; the former is much longer than the latter. And while the style of the essay welcomes the reader to the period, it also throws up more names and places and events than can be explained or even annotated adequately. This occurs both on a large and on a small scale. The first essay, on "Nicholas Hill, the English Atomist" contains such a vast array of names that at times it becomes the prosopo· graphical equivalent of a telephone book. A distinction between ‘activities’ and ‘processes’ plays an important role in Aristotle's argument to establish that the good life is a life of activities, among which metaphysical contemplation is foremost. But, as a result of having failed to distinguish internal from external ends of action, Aristotle makes fallacious inferences from every activity's having an internal end in itself to its possessing features which may be legitimately inferred only from external ends, and from every process's having an internal end that is (...) its terminal point to its having the attainment of that terminal point as an external end. The resulting confusion explains a number of problematic elements in Aristotle's ethical theory. (shrink)

Aristotle's doctrine of the mean is not a counsel to perform mean or moderate actions. It states that excellence of character is a mean state with regard to the having and displaying of emotions. All emotions are morally neutral; character is shown by displaying emotions on the right occasions, Not too often or too rarely, Not too strongly or too weakly, For sufficient and only sufficient reasons, Etc. The difficulties for such a view presented by justice and such bad emotions (...) as envy are discussed. The conclusion is that basically aristotle's theory can resist critical scrutiny. (shrink)

The title John Kekes has given to his book accurately describes its contents. The book is devoted to the development and defense of an original, complex, and persuasive theory of rationality, whose goal is to provide both a theoretical and a practical alternative to skepticism. To accomplish this purpose, Kekes believes, it is necessary to show that standards of rationality can be justified without either lapsing into arbitrariness or becoming entrapped in a vicious regress.

On its first appearance in 1960, J.O. Urmson's Concise encyclopedia of Western philosophy and philosophers established itself as a classic. Its contributors included many of the leading philosophers of the English-speaking world: Ryle, Hare, Strawson, Ayer, Dummett, Williams and many others. They wrote with an authority and individuality which made the Encyclopedia into a lively and engaging introduction to philosophy as well as a convenient reference work. For this edition, supervised by Jonathan Rée, the original articles have been revised and (...) updated, and eighty articles by thirty one new authors have been added. The additions take account of recent developments in philosophy, of literary, historical and political issues in philosophy, and of developments in continental thought, including in Marxism, psychoanalysis, phenomenology, existentialism, structuralism, post-structuralism and deconstruction. Integrated pest management (IPM) has been widely promoted in the developing world, but in many regions its adoption rates have been variable. Experience has shown that to ensure IPM adoption, the complexities of local agro-production systems and context-specific folk knowledge need to be appreciated. Our research explored the linkages between farmer knowledge, pest management decision making, and ecological attributes of subsistence maize agriculture. We report a case study from four rural communities in the highlands of southeast Honduras. Communities were typified (...) by their agro-environments, IPM training history, and levels of infestation by a key maize pest, the fall armyworm (Spodoptera frugiperda Smith). Although variable, infestation levels generally did not justify pest management intervention. Consequently, crop losses from this pest were considered of low importance and most farmers proceeded in a rational fashion by refraining from action in their fields. Farmers attributed the low degree of pest infestation predominantly to abiotic causal factors (rainfall, temperature). The role of natural enemies in controlling this pest (i.e., biological control) was deemed of low importance by farmers; nevertheless, a broad array of such organisms was mentioned by farmers as operating in their maize crop. Farmers’ knowledge of natural enemies only partially matched scientific knowledge and was associated with the ecological features of their respective field settings. Local knowledge about natural enemies was mainly restricted to abundant and easily observable predatory species. Farmers who were knowledgeable about biological control were also familiar with a larger variety of pest management alternatives than uninformed farmers. Management options covered a wide range of curative techniques, including conservation biological control. Farmers who relied on insecticides to manage pest outbreaks knew less about biological control and pesticide alternatives. In contrast, farmers who received IPM training mentioned more types of natural enemies and were familiar with a broader range of alternative pest management tactics. Our research suggests that IPM training modifies local knowledge to better fit its environmental context. This paper provides insights in the environmental context of local agro-ecological knowledge and its linkage with pest management decision making. It also constitutes a basis for modifying IPM extension programs to deliver locality-specific technologies while strengthening the local knowledge base. (shrink)

J.O. Urmson's The Greek Philosophical Vocabulary contains some five hundred alphabetically arranged entries, each aiming to provide useful information on a particular word used by Greek philosophers. The book includes a wealth of quotations ranging from the fifth century BC to the sixth century AD.

The second issue of Ordo IV of the Amsterdam edition of the Latin texts of Erasmus comprises the Querela Pacis and Erasmus’ Latin translations of some of Plutarch’s Moralia . The Complaint of Peace deals with peace and war, and the tension between love of one’s country and St. Paul’s admonishment to unity in Christianity.

Moral philosophers tend to discriminate, explicitly or implicitly, three types of action from the point of view of moral worth. First, they recognize actions that are a duty, or obligatory, or that we ought to perform, treating these terms as approximately synonymous; second, they recognize actions that are right in so far as they are permissible from a moral standpoint and not ruled out by moral considerations, but that are not morally required of us, like the lead of this or (...) that card at bridge; third, they recognize actions that are wrong, that we ought not to do. The spatial dynamics of the optical emission from an array of 50 times 50 individual microcavity plasma devices is investigated. The array is operated in argon and argon-neon mixtures close to atmospheric pressure with an ac voltage. The optical emission is analysed with phase and space resolution. It has been found that the emission is not continuous over the entire ac period, but occurs once per half period. Each of the observed emission phases shows a self-pulsing of the discharge, with (...) several bursts of emission of fixed width and repetition rate. The number of emission bursts depends on applied voltage and frequency. Spatially resolved measurements prove that the emission bursts are formed by overlapping emission pulses from single discharge cavities. Intensity differences between positive and negative half-wave can be interpreted through spatially resolved measurements of single discharge cavities. (shrink)

Localised configurations of the free electromagnetic field are constructed, possessing properties of massive, spinning, relativistic particles. In an inertial frame, each configuration travels in a straight line at constant speed, less than the speed of lightc, while slowly spreading. It eventually decays into pulses of radiation travelling at speedc. Each configuration has a definite rest mass and internal angular momentum, or spin. Each can be of “electric” or “magnetic” type, according as the radial component of the magnetic or electric field (...) vanishes in the rest frame, and each has an “antiparticle.” Any such configuration, of electric or magnetic type, is characterized in part by a set of labels (κ, ω0, σ,l, m), where ω0 is the mean of the angular frequencies of the plane waves making up the configuration, σ is the variance of those frequencies, κ is a positive constant with dimensions of action, andl, m are angular momentum “quantum numbers” withl a positive integer andm an integer such that ‖m‖≤l. Is inheritable genetic modification the new dividing line in gene therapy? The editors of this searching investigation, representing clinical medicine, public health and biomedical ethics, have established a distinguished team of scientists and scholars to address the issues from the perspectives of biological and social science, law and ethics, including an intriguing Foreword from Peter Singer. Their purpose is to consider how society might deal with the ethical concerns raised by inheritable genetic modification, and to re-examine prevailing views about whether (...) these procedures will ever be ethically and socially justifiable. The book also provides background to define the field, and discusses the biological and technological potential for inheritable genetic modification, its limitations, and its connection with gene therapy, cloning, and other reproductive interventions. Today, an increased impact of information and communication technologies in the society at large has lead teachers to engage in professional development activities related to the use of ICT. Even though this development has been prominent for more than two decades, its long term effects seem complex to determine. This paper is based on interviews with twelve Swedish teachers who participated in a national program for promoting school development and use of ICT in 2000-2001. The program was aligned with the (...) pedagogical approaches set out in the national Swedish curriculum, such as a shift from teaching to learning and giving pupils more responsibility, introducing interdisciplinary approaches to teaching in teams, and a problem based pupils-oriented pedagogy. The analysis of the interviews show that teachers still feel a high degree of appreciation for the program, and that they share a relative agreement of the importance of the program for their teaching with ICT in the last decade. The general intentions of the program to be more concerned with school development and pedagogy rather than technology and ICT seem also to be present today as a long term effect. (shrink)

Quanto aos territórios, eles se estabelecem em íntima conexão com os ambientes em suas dimensões paisagística e material, quer sejam os processos geoecológicos, (...) quer sejam as formas e as dinâmicas socialmente produzidas. Analisar os territórios significa examinar como, a cada momento, os ambientes, seus recursos e significados são disputados e viram objeto de conflitos.O público-alvo principal são os estudantes dos últimos anos da graduação, além daqueles em nível de pós-graduação, de todas as áreas que lidam com problemas e conflitos ambientais. Afora os pesquisadores iniciantes e os jovens universitários em geral, porém, podemos presumir que profissionais experientes também poderão tirar proveito do material de diversos capítulos. This book is an exercise in hermeneutics, or interpretation. In it Professor Rasmussen is concerned with an explanation of symbols and the myths in which they occur. Using the methods of phenomenology and taking advantage of the results of earlier interpreters of myths and symbols, particularly Eliade and Ricoeur, he develops and defends a view of symbolic language whose main theses include the following. Symbols and, thus, myths are authentic representations of a unique dimension of human consciousness, which can be (...) articulated only through them. A necessary expression of human experience, they represent man’s attempt to probe the ultimate foundations of meaning. The author illustrates these theses by an examination of symbolic language as it appears primarily in religious, but also in literary, social, and political discourse. The discussion is largely pre-philosophical, in the sense that little attention is given to the central epistemological question: Are the myths in which symbolic language occurs true? To the extent that the author addresses this question, the answer he gives appears to imply a relativistic skepticism. For example, he writes: "Reality is an individual and social construction". From the perspective of philosophy, this is the most important point made in the book; but it needs to be pursued much further than Rasmussen has done. (shrink)

Originally published in 1968, this book traces the development of the emotive theory of ethics from its outline by Ogden and Richards in The Meaning of Meaning to the elaborate presentation by Stevenson in Ethics and Language. Attention is paid to the positive features of the ethical theory whilst the author also shows how a more adequate view can be reached through critical reflection on it.

This article undertakes a critical examination of Kwame Gyekye’s main arguments for moderate communitarianism. Contrary to the general belief among African scholars, it contends that Gyekye’s moderate communitarianism, as he presents it in Tradition and Modernity (1997), is not as moderate as he believes it to be. The article also seeks to show that the gap which Gyekye claims exists between moderate or restricted and unrestricted communitarianism is not as wide as he suggests.
